OPERATION GARUDA – WHISTLE BLOWERS  PROTECTION ACT, 2011

A small time telugu hero by name Shivaji, who was BJP member till recently turned against BJP after BJPs U turn on special status to AP and became its bitter critic and off late being sided with TDP. In March,2018, he came out with a theory called “OPERATION GARUDA” and released 22-minute video, which states that a series of incidents are planned by BJP to destabilize AP which include life threat to important leader and already twice rekki was conducted, state government will be destabilized which may lead to elimination of state CM etc. 

With the attempt on Jagan with a small but very sharp and dangerous knife generally used in cock fights and CBN speaking about “OPERATION GARUDA” in a press conference in Delhi, it gained prominence and there is demand from many circles for immediate arrest of Shivaji and decode “OPERATION GARUDA”.  As Shivaji spoke about destabilizing the popular state Government, possible physical elimination of CBN, this is certainly a serious concern of the nation and needs attention of everyone.

On TV9 debate on 21.10.2018, Shivaji stated that he is getting information through a friend who is not known to him, he is getting calls from unknown numbers and he feels he is totally covered under Whistle Blowers Act, 2011.  

  

Whistle Blowers Prevention Act,2011:

• This act is to protect activists who share information on corruption, misuse of power, criminal offence by public servants. The names will not be revealed except to HODs if it is essential.

• Any public servant, any person including NGOs with their identity can reveal information to Central or State vigilance commissions. If the complaint is proved to be false, the complainants will be penalized.

Inference of this act to this case:

As I critically analyzed, this act will not be applicable to Shivaji or this case, as Shivaji made public statements in media about Operation Garuda, not with Central Vigilance Commission or state vigilance commission. I wonder how Shivaji is trying to take shield under whistle blowers protection act and get away.

Immediate action required:  

• As Shivaji revelations are very serious nature which attracts National security act, he shall be immediately called back from USA, where he is presently camping and shall be thoroughly investigated.

• 22 Minute video he recorded on Operation Garuda, various press statements he released, statements of other leaders on this operation, various other information on this shall be compiled by CVC and get into action very quickly.

• No need to wait for a formal complaint, as Shivaji statements itself can be taken as proofs and action can be initiated.

• The unknown phone numbers, unknown persons who are revealing these operations as claimed by Shivaji shall be traced and joint investigation along with Shivaji will bring out the real facts.
• As the issues like threat to life CM, Destabilization of state Government etc are related to internal security of the nation, Home ministry and National security council can immediately get into action.

• The culprits however influential they are shall be punished severely.
